Appeal Court Upholds Dethronement of Enugu Traditional Ruler

The Court of Appeal in Enugu has upheld the dethronement of the Traditional Ruler of Okpogho Community, Ezeagu L.G.A of Enugu, Pastor Linus Chimereze. The court affirmed the judgment delivered by Hon. Justice R. O. Odugu on July 27, 2018, which deposed Pastor Linus Chimereze from his position.

Delivering the leading judgment on August 1, 2023, Hon. Justice Olubunmi Oyewole upheld the decision of the trial court, stating that the election of the Traditional Ruler violated Enugu State's Traditional Ruler's Laws and was marred by irregularities and impunity.

The appeal filed by the dethroned Igwe was dismissed by the Court of Appeal, with costs of N250,000 awarded against the Appellant in favor of the Respondents. All the five issues presented on behalf of Pastor Linus Chimereze were resolved in favor of the Respondents, Chief Onuorah Cosmas & 2 Ors.

During the appeal, A. I. Ani SAN argued that the trial court had no jurisdiction to hear the case due to alleged issues with the writ of summons and claims, which were not signed by the Plaintiffs or their Counsel. However, S. A. Okolo Esq for the Respondents countered the argument, maintaining that the originating processes had no defects as they were properly signed by Counsel.

In conclusion, the Court of Appeal upheld the dethronement and dismissed the appeal No. CA/E/859/2018, thereby confirming the removal of Pastor Linus Chimereze as the Traditional Ruler of Okpogho Community.
